Former Sheriff David Clarke will face trial over an incident that occurred in an airport when he was approached by a man named Daniel Black, who wanted to know if it was really him.
Upon informing Black that he was indeed David Clarke, Black shook his head and walked away. Six deputies met Black upon arrival, questioned him, and escorted him out of the airport. Black then posted to social media regarding the incident and filed a lawsuit, citing violation of his civil rights. Sheriff Clarke fired back in a statement posted to his Facebook page, calling Black a “snowflake.”Although a judge found that most of Black’s claims were without merit, one regarding the social media post will proceed forward to a jury trial.
According to Black, Sheriff Clarke violated his First Amendment right to shake his head by retaliating against him on Facebook. Black had also previously sued the county and six deputies who detained him, but that lawsuit was also thrown out.
